Policy
Elarabeat policy.
Last updated: May 5, 2026. This policy reflects the current Elarabeat version, including Studio lyrics, uploaded album review, Community Streaming publishing, Moderation Hold, admin review, disputes, takedowns, and support automation.
1. Provider-aligned use
Your use of Elarabeat must comply with applicable law, this policy, and any provider rules that apply to the underlying tools used in the product. That includes current OpenAI usage rules and the current ElevenLabs terms, prohibited-use rules, and music-related terms where applicable.
2. Acceptable use and prohibited conduct
- You may not use Elarabeat for illegal, exploitative, abusive, fraudulent, deceptive, hateful, harassing, or violent misuse.
- You may not use Elarabeat to create, promote, or distribute child sexual abuse material, non-consensual intimate content, extremist propaganda, scams, malware, or unlawful surveillance or impersonation.
- You may not upload or prompt with content unless you have the rights, permissions, licenses, and consents required to use it.
- You may not use Elarabeat to infringe copyright, trademark, publicity, privacy, or other rights, including by uploading media you do not control.
- You may not attempt to bypass safeguards, moderation, account limits, billing limits, or security controls.
3. Music-specific restrictions
If any workflow in Elarabeat uses ElevenLabs Music or other provider music-generation services with similar restrictions, you must not submit prompts or references that violate those provider terms.
- Do not use real artist, songwriter, band, label, song, or album names where the underlying provider disallows them.
- Do not provide copyrighted lyrics, substantial lyric excerpts, or references intended to reproduce a protected work.
- Do not ask the product to clone, imitate, or misrepresent a real person's identity, likeness, or voice without all required rights and permissions.
4. User content and rights responsibility
You are responsible for any content you upload, enter, submit, generate, edit, publish, distribute, or share through Elarabeat.
- Content includes lyrics, prompts, creative briefs, song titles, album titles, cover art, uploaded images, uploaded audio, ZIP or folder uploads, metadata, AI-assisted outputs, AI-generated outputs, and Community Streaming releases.
- Before generating, verifying lyrics, uploading an album, saving a release, or publishing to Community Streaming, you must confirm that you own or have obtained all rights, licenses, permissions, consents, and clearances needed for that content.
- You may not upload, enter, request, generate, publish, distribute, or share content that infringes or misappropriates another person's copyright, trademark, publicity rights, privacy rights, or other rights.
- Private drafts are not public releases. A private draft can still be held, reviewed, removed, or blocked from publishing if it appears to include protected lyrics, artist imitation, unauthorized samples, trademarked branding, unsafe material, or other rights-sensitive content.
5. Lyrics, copyright, and generated text
- You are responsible for lyrics you manually enter, upload, request, generate, edit, publish, distribute, or share through Elarabeat.
- Do not submit lyrics copied from copyrighted songs, lyrics that are substantially similar to protected works, or lyrics that otherwise violate another party's rights unless you have permission or a valid legal basis.
- Manual lyric verification, automated moderation, copyright-risk screening, and AI closer-look review are assistive tools only. Passing a check does not mean content is lawful, original, non-infringing, cleared, or eligible for publication.
- If lyrics are flagged or blocked, the album may be rejected, Community Streaming publishing may be blocked, and repeated or serious violations may affect account access.
6. Uploaded files and album materials
- You may upload only files you own or have permission to use, including images, audio, lyrics, ZIP packages, folder uploads, and metadata.
- Uploaded materials may be scanned for unsafe files, unsupported formats, malware risk, prohibited content, copyright or IP risk, moderation violations, and rights-sensitive metadata.
- Elarabeat may reject, block, delay, remove, ignore, or require review for uploaded albums, images, audio, lyrics, ZIP contents, folder contents, or metadata.
- If an uploaded image is rejected, flagged, unavailable, or cannot be safely used in a given generation flow, Elarabeat may ignore that upload and regenerate artwork using default server-side control images or other safe defaults.
7. Publishing eligibility and review holds
- Publishing content to Community Streaming or release areas is not guaranteed.
- Generated albums and uploaded albums may be scanned again before publishing. Uploaded albums and user-provided materials may require more review time than fully Studio-generated albums.
- Automated review or admin review may place a release on Moderation Hold. During review, publishing countdowns, public visibility, edits, or release actions may be paused, delayed, frozen, limited, or blocked.
- Elarabeat may approve, reject, remove, take down, keep private, limit visibility, request more information, or annotate a release if it appears to violate this policy, applicable law, provider rules, or third-party rights.
- Review systems and admins may make mistakes. Users may use the available dispute, support, or admin-review process where the app provides one.
- Guest playback previews and non-entitled playback may be limited, including short previews where Elarabeat applies preview limits.
8. Repeat violations and account enforcement
- Repeated or serious violations may result in warnings, rejected album processing, blocked generation, blocked publishing, content removal, loss of credits where allowed by policy, temporary suspension, or permanent account termination.
- Elarabeat may adopt and enforce a repeat-infringer policy for copyright complaints in accordance with applicable law.
- Attempts to bypass moderation, rights checks, account limits, billing limits, or security controls may lead to enforcement action.
9. Copyright complaints and counter-notices
If you believe content on Elarabeat infringes your copyright or other intellectual property rights, use the support or contact link in the footer. Elarabeat may remove or disable access to disputed material while reviewing complaints, counter-notices, or appeal information.
- A complaint should include the rights owner's name and contact information, a description of the copyrighted work, the Elarabeat URL or location of the allegedly infringing content, a good-faith statement, an accuracy statement, and a physical or electronic signature.
- If Elarabeat supports a counter-notice for a specific complaint, the counter-notice should include enough information to identify the removed content, explain why you believe removal was mistaken, and let Elarabeat contact you about the dispute.
- TODO before final legal publication: confirm the designated copyright email address or copyright complaint form.
10. AI support summaries
- If Elarabeat uses unresolved or delegated support issues to improve support quality, it may store condensed support summaries for that purpose.
- This support-learning system should use summaries rather than full chat histories unless a separate disclosure says otherwise.
- Unused support-learning summaries are intended to be pruned after 30 days under the planned support memory workflow.
11. Outputs, ownership, and no clearance guarantee
Elarabeat's commercial-use rights depend on the plan that was active when the output was generated. This section is intended to reflect the same general paid-versus-free commercial licensing approach used by leading AI media platforms, while remaining specific to Elarabeat.
- AI-generated outputs may be inaccurate, incomplete, offensive, non-unique, or unsuitable for your intended use.
- All paid Elarabeat plans include a commercial license for albums and related outputs generated during an active paid subscription, provided you have all required rights in your inputs and your use complies with these Terms, applicable law, and provider restrictions.
- Commercial licensing for paid-plan outputs does not guarantee exclusivity, sole ownership against third parties, originality, or non-infringement, and Elarabeat may continue to host, moderate, or manage service copies as needed to operate the platform.
- Free plans do not include commercial-use rights. Outputs generated on a free plan, or outside an active paid subscription, remain under Elarabeat's custody and may not be used commercially unless Elarabeat expressly grants written permission.
- You are solely responsible for reviewing and clearing every output before publication, release, licensing, distribution, advertising, or commercial use.
- You remain responsible for rights clearance, disclosures, metadata, credits, legal review, and any downstream use of the output.
- Elarabeat tools do not provide legal advice, rights clearance, or copyright guarantees. AI moderation, lyric verification, and copyright-risk checks are assistive tools only.
- Elarabeat does not guarantee that any output will be exclusive, original, error-free, lawful, cleared, publication-eligible, or non-infringing.
12. Billing, cycle allowances, and refunds
Elarabeat is an evolving, model-driven service and operates on a use-it-or-lose-it basis. Cycle-based allocations are intended for use during the active billing cycle and do not create stored-value rights unless required by law.
- Included plan allowances, usage cycles, jobs, cover generations, remakes, and similar recurring entitlements reset or expire at the end of the applicable cycle and do not roll over unless Elarabeat expressly states otherwise in writing.
- Except where required by applicable law, subscription fees, used credits, completed jobs, and consumed usage are non-refundable.
- In special circumstances only, Elarabeat may consider reimbursement of unused personal credits, if any, after receiving a clear written explanation for the request. Any such reimbursement is discretionary, limited to the unused personal-credit balance, and does not apply to used or expired cycle allowances.
- Elarabeat may deny refund requests that do not include a reasonable explanation, relate to used credits, or arise from dissatisfaction with normal model variation, evolving model behavior, or policy-enforced moderation outcomes.
13. Service evolution
- Elarabeat may change prompts, models, providers, safety systems, workflows, styles, outputs, limits, layouts, and features over time.
- Generations may differ from prior results even when the same or similar inputs are used.
- Elarabeat may suspend, restrict, or terminate access for abuse, provider-risk, payment issues, safety concerns, or policy violations.
14. Disclaimer of warranties
To the maximum extent permitted by applicable law, Elarabeat and its software, outputs, integrations, and related services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, availability, or uninterrupted operation.
15. Limitation of liability and indemnity
To the maximum extent permitted by applicable law, Elarabeat, its owners, operators, affiliates, licensors, vendors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or business interruption, arising out of or related to your use of, inability to use, or reliance on the product, software, uploads, or outputs.
To the maximum extent permitted by law, Elarabeat's total aggregate liability for any claim arising out of or relating to the service will not exceed the greater of the amount you paid directly to Elarabeat for the service in the 12 months immediately preceding the event giving rise to the claim, or $100 USD.
You are responsible for your use of the product and, to the maximum extent permitted by law, agree to defend, indemnify, and hold harmless Elarabeat and its owners, operators, affiliates, licensors, and service providers from claims, damages, liabilities, losses, and expenses arising from your inputs, uploads, releases, distribution, misuse, or violation of this policy or applicable law.
Nothing in this policy limits or excludes liability that cannot legally be limited or excluded under applicable law.
16. Policy updates
Elarabeat may update this policy at any time as the product evolves or as provider rules, legal requirements, or operational needs change. Continued use of the service after an update constitutes acceptance of the revised policy.
